Legal basis
Amendment to the Police and Border Guard Act passed by the Riigikogu on 8 October 2025 (49 votes to 16) and promulgated by the President on 20 October 2025, taking effect ten days after publication in Riigi Teataja. ERR reports that camera placement must rest on a written, specific threat assessment for the location, that photos must be deleted after 45 days, and that the Police and Border Guard Board, the security agencies and the Tax and Customs Board have access to the data.
Oversight
The Data Protection Inspectorate opened a supervisory procedure at the end of April 2025. According to the board's Roger Kumm, as reported by ERR on 22 October 2025, the amended act requires a data protection audit once a year.

Notes

ERR reported on 14 May 2025 that Interior Minister Igor Taro suspended the Police and Border Guard Board's use of its number plate recognition cameras, a network of more than 200 cameras, until the necessary laws were amended; the board described the suspension as temporary, until legal clarity was reached. Taro said the rules needed more precise regulation; the Chancellor of Justice's office had said the legal basis was not sufficient, and the Data Protection Inspectorate that it was not clear enough. The board's own audit, reported by ERR on 30 May 2025, found shortcomings in the risk assessments made before cameras are installed and in following up plate queries. On 6 August 2025 ERR reported that the Inspectorate had ordered the board to archive and delete data held past its retention period in a procedural information system within POLIS, and that the latest camera recordings would be deleted by 14 August. After the Riigikogu passed a new act, ERR reported on 22 October 2025 that the board's Roger Kumm said it was ready to bring the cameras back into use under the new rules once the act took effect. The sources do not report that the cameras have been switched back on, so the record is shown as paused.
