A private facial recognition system used by retailers rather than by police, which is what makes it worth tracking here: it is a commercial deployment whose output increasingly flows to the state. That flow became direct in July 2026, when Facewatch's Crime Management Platform began automatically alerting police to repeat-offender matches across more than 125 retailers. Until then, retail facial recognition alerts reached police only through a shopkeeper choosing to report. This is a material change to the private-to-state data pathway and the most significant development on this entry. Misidentification harm is now documented repeatedly. Sainsbury's paused use at one store on 17 August 2026 after a customer was falsely accused of shoplifting, while continuing to expand the system from 55 stores towards up to 200 by the end of 2026. Guardian reporting in May 2026 documented shoppers falsely identified struggling to clear their names, with limited routes of appeal. Regulatory position has moved beyond the ICO's 2023 findings: the ICO opened an investigation in February 2026 into a case in which a B&M shopper was wrongly accused of theft. Facewatch obtained ISO/IEC 42001 AI management certification in June 2026. The February 2026 ICO investigation rests on a single regional outlet and would benefit from corroboration against an ICO statement.
