Notes

The Justice Department's 2025 AI use case inventory (entry DOJ-0226, as consolidated by the Office of Management and Budget) lists facial recognition technology from Clearview AI at the US Marshals Service as deployed and high-impact, with an operational date of January 2022. The entry says the tool "assists with the possible identification of an investigative subject" by matching a query photograph with publicly available images, that it is "only an investigative lead and never grounds for law enforcement actions", and that leads must be corroborated with other techniques before action is taken; it shows the required risk-management steps as still in progress. FedScoop (11 February 2026) reported that the use was first listed in the 2024 inventory. GAO's September 2023 report, which covered October 2019 to March 2022, found the Marshals Service still using facial recognition services as of April 2023; its guidance required Clearview AI searches to have "a direct nexus to an active fugitive investigation", it made training mandatory in February 2023, and it had cut active Clearview AI accounts from 103 to three. Federal procurement records published by Biometric Update (printed 11 February 2026) show a Marshals Service purchase order to Clearview AI of $20,000 signed on 8 February 2024, with modifications of $20,000 (13 February 2025) and $55,000 (10 April 2025). The inventory date may not mark the first use, so the start date is left open.
